Experience:

Between 2000 and the end of 2011, Karyn was working in the Commercial Team at Brisbane City Legal Practice - the in-house legal practice of the Brisbane City Council.  

Karyn joined King & Company’s Commercial, Advisory & Property Group in January 2012.  Her experience includes:

• statutory interpretation and subject-specific advice on application of various pieces of legislation within the local government context, including water specific legislation;
• advising on processes within and compliance with conditions and requirements of requests for tenders/proposals and expressions of interest;
• advising on, and drafting, various agreements including goods and services agreements, consultancy agreements, funding and grant agreements, event management agreements, water access agreements, and mining compensation agreements under the Mineral Resources legislation;
• advising on contractual issues, such as variations, progress payment claims under the Building Industry Fairness (Security of Payment) Act 2017 (Qld) and disputes arising out of AS4000 1997 construction contracts and AS4902 2000 design and construction contracts; and
• intellectual property rights protection, assignments and licences.

Significant recent matters Karyn has undertaken include:

• responding to a claim made against a Council under the Building Industry Fairness (Security of Payment) Act 2017 (Qld)  (“BIF Act”).  The time limits imposed by the BIF Act for responding to such claims are very tight and require effective coordination between the Council, the contract superintendent and the Council’s lawyers.  Under the supervision of King & Company partner, John Butt, Karyn was able to successfully undertake that coordination with the result that effective responses to the claim were provided and the matter was ultimately resolved very much in the Council’s favour; 
• drafting tender documentation including a sales agreement for a partial assignment of a Council’s Forestry Act sales permit and, on behalf of the Council, liaising with the Department of Agriculture and Fisheries to ensure the successful and timely completion of the sale to a fit and proper third person.  This matter was supervised by King & Company Partner, Tim Fynes-Clinton.
