Prosecutions & Enforcement

We’ve conducted prosecutions for our local government clients for breaches of the full ambit of legislation relating to local government administration such as development approvals, animal control local laws, control of advertisement local laws, vegetation protection local laws, the various provisions of the Sustainable Planning Act 2009, the Environmental Protection Act 1994, the Water Act 2000 and the Building Act 1975.

We know what’s required to build a prosecution from scratch and we work with Council officers as part of a prosecution unit to maximise the likelihood of a Council’s success.  Our detailed knowledge of applicable principles means we know whether prosecution matters should be pursued in the Magistrates Court or, where there’s genuine urgency to restrain an unlawful activity, the District or Supreme Courts.
